ANJANA PRAKASH ORAL JUDGMENT Date: 16-02-2015 The Petitioner seeks quashing of the order of cognizance dated 27.03.2012 passed by the Railway Judicial Magistrate, Gaya in Gaya G.R.P.S. Case No. 127 of 2010.

The submission of the Petitioner is that he was a Railway Clerk at the relevant time but delivery of goods was not part of his officially duty. The further submission is that final report was submitted in the matter.

Since these are matters which can only be gone into at the stage of trial, I am not inclined to interfere in the matter. The application is dismissed.

The Trial Court is directed to expedite the trial and conclude the same without granting unnecessary adjournment to any party and for which reason it shall send a list of the witnesses

Patna High Court Cr.Misc. No.20295 of 2012 dt.16-02-2015 fixing specific dates for production of the witnesses along with a copy of this order, to the Superintendent of Police, Gaya, and the Superintendent of Police, Gaya is directed to ensure production of the witnesses on the date so fixed by the Trial Court so that there is no further delay in trial.
