====================================================== CORAM: HONOURABLE MR. JUSTICE RAJESH KUMAR VERMA ORAL ORDER 22-02-2022 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Nabinagar P.S.Case No.298 of 2019 registered for the offence under Sections 498(A)/326/307/34 IPC and subsequently Section 304(B) IPC and 3/4 Dowry Prohibition Act also added. The informant is wife of the petitioner. On 03.11.2019 at about 8.00 A.M., her husband, father-in-law, mother-in-law and sister-in-law poured kerosene oil over her body and all accused persons ablaze her alive that due to that fire she has been seriously burnt and when she alarmed the nearby people came to rescue her and after putting down the fire they brought her to the hospital.

Learned counsel appearing for the petitioner submits

Patna High Court CR. MISC. No.27805 of 2021(5) dt.22-02-2022 2/2 that the petitioner has clean antecedent. He has falsely been implicated in the present case only on the ground that the petitioner is husband of the deceased.

Vide order dated 25.01.2022, a report was called for with regard to the stage of the trial. Vide letter dated 09.02.2022, a report has come which reveals that out of eight witnesses, five have been examined and the trial is going on. Considering the aforesaid facts, I am not inclined to enlarge the petitioner on bail in connection with Nabinagar P.S.Case No.298 of 2019 pending in the court of learned Chief Judicial Magistrate, Aurangabad.

Prayer is refused.

However, the learned Trial Court is directed to expedite the trial.
