JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-10-2017 The petitioner seeks regular bail in connection with Danapur P.S. Case No. 580 of 2017, registered for offences punishable under Sections 379 & 411 of Indian Penal Code. Allegation is of committing theft of several articles worth more than one crore with the help of crane.

It has been submitted on behalf of the petitioner that he has falsely been implicated and he only happens to be driver of the crane and has nothing to do with the alleged offence. Further he has no criminal antecedent and has been in judicial custody since 23.08.2017.

Learned counsel for the State opposed the prayer for bail on the ground that petitioner was arrested on spot and he has also confessed his guilt.

Having heard both sides, considering the fact and

No.50777 of 2017 (2) dt.18-10-2017 circumstances of the case and nature of allegation, I am not inclined to release the petitioner on bail at this stage rather this application is disposed of with direction to the court below to release the petitioner to his own satisfaction, once charge is framed in this case or petitioner completes six months of judicial custody, whichever is earlier.
