Sanjay, Additional Solicitor General of Inida that the Union of India has been made opposite party no. 2 however, it is not a necessary party in the present proceeding since the case is being investigated by the State polilce and, therefore, a prayer is made for deletion of opposite party no. 2 from the array of party in the present case. It is further submitted that whatever proper or relevant material is required to be provided during the course of enquiry would be provided to the State Government or to the Court as the case may be.

Patna High Court Cr.Misc. No.51774 of 2017(2) dt.09-11-2017 2/3 Accordingly, the opposite party no. 2, i.e. the Union of India through Inspector General, S.S.B., Frontier Head Quarter, Patna is deleted from the array of parties. I have heard learned counsel for the petitioner and the State.

The petitioner seeks bail in a case registered for offences punishable under sections 272 and 273 of the Indian Penal Code and Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, 70 litres 550 Ml. of country-made liquor was recovered from the possession of the petitioner. Petitioner claims that he is having clean antecedent and is in custody since 5.9.2017. Having regard to the facts and circumstances of the case, the above named petitioner is directed to be released on bail on his furnishing bail bond of Rs. 10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise Act, East Champaran at Motihari, in connection with Chhauradano (Mahuawa) P.S. Case No. 209 of 2017.

If the petitioner, after his release in this case, is again found involved in similar nature of cases then the concerned
