JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 13-03-2015 The two petitioners, who are brothers, apprehend arrest in Ishipur (Barahat) P.S. Case no. 78 of 2013 instituted under section 302 of the Indian Penal Code and also under section 27 of the Arms Act.

Learned counsel for the petitioners draws the attention of this Court to the F.I.R. which has been lodged against unknown as no one had seen how the informant's brother had been shot dead in his house. In course of investigation, brother of the petitioners, namely, Zubair Khan is said to have been arrested and confessed that he had shot the deceased when he was fighting with the petitioners.

Learned counsel for the petitioners submits that

Patna High Court Cr.Misc. No.36169 of 2014 (2) dt.13-03-2015 even if this be the sole evidence against the petitioners, the petitioners cannot be implicated in this case. Be that as it may, in the event of arrest or surrender of the petitioners above named within four weeks from today, they shall be released on bail on furnishing bonds of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhagalpur in connection with Ishipur Barahat P.S. Case No. 78 of 2013 subject to all conditions as laid down in section 438(2) of the Code of Criminal Procedure, 1973.
