The petitioner seeks bail in connection with Kalyanpur P.S. Case No. 1 of 2018 registered under Sections 272, 273 of I.P.C. and Sections 30(a), 38 and 47 of the Bihar Prohibition and Excise Act 2016.

12 lts. of foreign liquor is said to have been recovered from motorcycle and petitioner and one other accused, namely, Sujeet Kumar managed to escape seeing the police party. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from conscious physical possession of the petitioner. He has no concern either with the seized liquor or with the motorcycle in question. He

Patna High Court Cr.Misc. No.41461 of 2018(2) dt.11-07-2018 2/2 has been falsely implicated in this case due to dirty village politics. Though, several cases have been lodged against the petitioner, but he is on bail in the said cases except one. He has been languishing in custody since 31.03.2018. Co-accused Sujeet Kumar has been enlarged on bail by a co-ordinate Bench of this Court vide order dated 19.04.2018 passed in Cr. Misc. no. 20128 of 2018.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 6th Addl. Sessions Judge-cum-Special Judge, Excise, Samastipur in connection with Kalyanpur P.S. Case No. 1 of 2018. (Prakash Chandra Jaiswal, J) rohit/- U T
