JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-06-2019 This is an application for grant of anticipatory bail in connection with Routa P.S. Case No.46 of 2018, disclosing offences under Sections 304B, 201, 120B, 302 of IPC. Prosecution story is that wife of the accused Naved Alam was missing and also her dead body was found near a pond and her husband and other accused were named in the F.I.R. and later on, name of the petitioner also transpired in the confessional statement of the husband of deceased. Submission of the learned counsel for the petitioner is that he is not related to the husband of the deceased and has falsely been implicated in this case.
Heard learned A.P.P. and learned counsel appearing on behalf of the informant, who has opposed the prayer for bail on the ground that confessional statement of the husband of the deceased clearly shows the active involvement of the petitioner
Patna High Court CR. MISC. No.15880 of 2019(5) dt.28-06-2019 2/2 and case is still under investigation.
Having heard both sides, in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below and make prayer for regular bail, the same shall be considered by the learned court below on its own merit.
