This application, for grant of regular bail, arises out of Gopalganj P.S. Case No.58 of 2021, registered for the offences punishable under Sections 30(a) and 41(1) of the Bihar Prohibition and Excise (Amendment) Act, 2018. The learned counsel for the petitioner submits that petitioner is in custody since 25.01.2021 and is a person of clean antecedent and charge-sheet has been submitted. Learned counsel for the petitioner further submits that from allegation, as alleged in the FIR, it would be manifest that 186.400 litres liquor has been recovered from the possession of the petitioner with which the petitioner has no concern.

Learned APP vehemently opposed the prayer for bail.

Patna High Court CR. MISC. No.27895 of 2021(2) dt.22-11-2021 2/2 Considering the fact that charge-sheet has been submitted against the petitioner is person of clean antecedent and he is in custody since 25.01.2021, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 5,000/- (five thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional District and Session Judge-cum-Special Judge, Excise, Gopalganj, in connection with Gopalganj P.S. Case No.58 of 2021.
