Petitioner is in custody since 09.03.2018 in connection with Kusheshwar Asthan P.S. Case No. 231 of 2016 registered under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner has submitted that the petitioner is innocent and has not committed any offence. In fact, the petitioner has not been named in the F.I.R. and the named accused persons have been granted bail by a co-ordinate Bench of this Court in Cr. Misc. No. 26224 of 2017 and Cr. Misc. No. 5324 of 2017. The petitioner has been languishing in the judicial custody for the last four months.

Considering the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond

Patna High Court Cr.Misc. No.42930 of 2018 (2) dt.19-07-2018 of Rs. 10,000/- (Ten Thousand rupees only) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Biraul, Darbhanga in connection with Kusheshwar Asthan P.S. Case No. 231of 2016.
