The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 120(B), 385 and 307 of the Indian Penal Code read with Section 27 of the Arms Act.
Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that on 13.11.2020 at about 10:00 am he got secret information that six named accused persons, including the petitioner, and some unknown miscreants armed with weapons had captured 34 bighas of land of various parchidars under conspiracy and even resorted to firing.
Learned counsel for the petitioner submits that from
Patna High Court CR. MISC. No.17035 of 2022(2) dt.16-06-2022 2/2 bare perusal of the allegation as alleged in the F.I.R. it would manifest that there is allegation of firing but no one was injured in the firing nor anyone received any gunshot injury. It is next submitted that the land belongs to the petitioner and parchidars are claiming false possession over the same and the matter is disputed.
Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
Considering the submissions made by the learned counsel for the petitioner and the fact that no one received any gunshot injury, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Pipariya P.S. Case No. 88 of 2020 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
