JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 31-07-2017 Today also nobody is present on behalf of the appellants. Learned counsel for respondent no. 1 is present. On behalf of respondent no. 1 it is submitted that respondent no. 2 Banarsi Mandal died on 29.06.2010 but no steps for substitution of his legal heirs and representative has been taken by the appellants. The respondents no. 1 and 2 both were the plaintiffs in the learned court below and as such the whole appeal has abated. On 25.07.2017 the matter was pressed and for the ends of justice one chance was given to the appellants and today the matter was fixed but today also no one is present on behalf of the appellants.

Under the circumstances, this appeal has abated as a whole.
