JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-07-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Dhamdaha Police Station Case No. 144 of 2006 registered for the offences punishable under Section 304B/34 of the Indian Penal Code.

Petitioner no. 1 happens to be gotni whereas petitioner no. 2 is mother-in-law of the deceased.

It would appear from the first information report itself that the marriage of deceased had taken place three years ago and after marriage she had been residing at her matrimonial home till her death. Moreover, no specific over act of torture and illegal

Patna High Court Cr.Misc. No.28597 of 2015 (2) dt.24-07-2015 2/2 demand of dowry has been leveled against these petitioners. Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioners, in the event of their arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Purnea in Dhamdaha Police Station Case No. 144 of 2006, subject to condition as laid down under Section 438(2) of the Cr.P.C.
