Petitioner, already in custody, seeks bail in connection with Alouli P.S. Case No.248 of 2017, registered under Sections 302/34 of the Indian Penal Code as well as under Section 27 of the Arms Act.

Allegation in brief is that due to land dispute in the night the accused persons came and it is alleged that Arjun Yadav opened fire aiming informant's daughter but she escaped and subsequently Ravindra Yadav also fired shot which hit the daughter of the informant and she died at the spot. Learned counsel for the petitioner submits that there is no specific allegation of firing on the deceased by the petitioner

Patna High Court Cr.Misc. No.61257 of 2017 (2) dt.20-12-2017 2 /2 rather it is alleged against Ravindra Yadav and Arjun Yadav, there is land dispute between both sides, so petitioner has falsely been implicated in this case, police has submitted charge-sheet against the petitioner, the petitioner has got no criminal antecedent and he is in custody since 01.09.2017.

Having considered the said facts and circumstances, let petitioner, Arun Yadav, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Khagaria in connection with Alouli P.S.
