Mr. Anita Kumari , APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 10-04-2025 At the outset, learned counsel for the petitioners seek permission to withdraw the pre-arrest bail petition of petitioner No. 2.

2. Permission is accorded.

3 . This bail petition of petitioner No. 2 is dismissed as withdrawn .

4. Heard learned counsel for the petitioner Nos. 1 , 3 , 4 and 5 and the State .

5 . Petitioners apprehend their arrest in a case registered for the offence punishable under sections 126 ( 2 ),

Patna High Court CR. MISC. No.18251 of 2025(2) dt.10-04-2025 2/3 115 ( 2 ), 308(3) , 303 ( 2 ) and 3 (5) of the BNS 2023 .

6. As per F.I.R., on the alleged date and time of occurrence , when informant was ploughing his field, in the meantime , all the F.I.R., named accused persons including these petitioners armed variously stopped the tractor and assaulted driver of the tractor and also snatched gold chain from his neck and also took Rs. 25,000/- from him.

7. It is submitted on behalf of the petitioners that assertion of right, title and possession by both parties over a piece of land, led to maarpeet between both the parties in which both sides sustained injuries. Case and counter case . Injuries sustained by the injured is simple in nature . 8 . Learned counsel for the State oppose the bail petition .

9. Considering the nature of injury and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioner Nos. 1 , 3 , 4 and 5 as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate Begusarai in connection with Bakhari P.S. Case No. 461 of 2024 , subject to the conditions laid down under section
