The petitioner apprehends his arrest in a case under Sections 419, 420 and 474 of the Indian Penal Code and Section 10 of the Bihar Examination Control Act.
The petitioner applied for appointment on the post of Constable. One Pooja Kumari was caught appearing at the examination in place of the petitioner. It is submitted that the admit card of the petitioner was lost. The petitioner informed the Examination Superintendent about missing of her admit card. The petitioner, therefore, could not appear at the examination but from perusal of the record, it appears that it was the petitioner who set up Pooja Kumari to appear at the written examination in her place for appointment on the post of Constable, but Pooja Kumari was caught red-handed at the examination centre.

No.27001 of 2015 (2) dt.20-07-2015 2/2 These types of offences are very much prevalent as in different examinations many persons impersonated other persons and secured appointment through clandestine method. Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail in Magadh Medical College Hospital (MMCH) P.S. Case No. 145 of 2014. Accordingly, the same is rejected.
