JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-01-2018 Earlier prayer for bail of the appellant was rejected vide order dated 12.9.2017 passed in Cr.Appeal(SJ) No. 2184 of 2017 with an observation to renew his prayer for bail after framing of charge.
Submission of learned counsel for the appellant is that charge has been framed in this case and he is in custody for six months and he is ready to abide by any condition that may be imposed on him, if bail is granted.
Heard learned Special P.P. also.
Having heard both sides and in the facts and circumstances, the appeal is allowed and the impugned order dated 6.11.2017 passed by learned Additional District and Sessions Judge-I, Sheikhpura is set aside.
Patna High Court CR. APP (SJ) No.3386 of 2017 (4) dt.17-01-2018 2/2 Let the appellant, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional District and Sessions Judge-I, Sheikhpura, in connection with SC/ST Case No. 180 of 2017, arising out of Sheikhpura Mahila P.S.Case No. 51 of 2016, subject to the conditions that (1) one of the bailors shall be local person having sufficient immoveable property in the jurisdiction of court concerned and (2) appellant shall co-operate in trial and appear in court as and when required, except on genuine reason, failing which his bail bond shall be cancelled.
