JUSTICE ARUN KUMAR ORAL ORDER 19-07-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Falkaha P.S.Case No. 79 of 2017 registered under Section 392 of the Indian penal Code.

Allegation in brief is that a robbery was committed by three miscreants and Rs. 55,635/- of the informant was looted away by them and during investigation petitioner made confession and accordingly looted mobile of the informant was also recovered from his possession and as per statement of the another co-accused, motorcycle in question was used in the crime.

Submission is that petitioner has been made accused on the basis of his confessional statement and he is in custody since 29.03.2018.

Patna High Court Cr.Misc. No.43023 of 2018(2) dt.19-07-2018 2/2 Whereas learned counsel for the State submits that there is recovery of looted mobile of the informant from the possession of the petitioner and he has also criminal antecedent of similar nature.

Having considered the aforesaid facts and circumstances, presently the prayer of bail of the petitioner is rejected, however, he may renew prayer of bail after six months of framing of charge.
