====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 06-12-2021 Heard Mr. Sunil Kumar Singh, learned counsel for the petitioner and Mr. Bhanu Pratap Singh, learned Additional Public Prosecutor appearing for the State.
Petitioner seeks regular bail in connection with Mahua P.S. Case No. 399 of 2020 registered for the offences punishable under Sections 304(B) and 201/34 of the Indian Penal Code 1860.
The allegation as per the First information Report is that the daughter of the informant was married to Sanjay Manjhi and it has been alleged that sometime after the marriage, Sanjay Manjhi started demanding a Motorcycle and due to nonfulfillment of the dowry demand, he had threatened to kill the daughter of the informant. No.28214 of 2021(2) dt.06-12-2021 2/3 15.7.2020 at about 12:30 p.m. the informant got information on phone regarding the death of her daughter and when the informant reached at the place of funeral along with the Police, Sanjay Manjhi, the husband of the deceased along with other persons, fled away.
Learned counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged and he has falsely been implicated in this case due to oblique motive. Learned counsel further submits that the petitioner is not the family member of the husband of the deceased and he is resident of another village and not of the village where the daughter of the informant was married. Learned counsel next submits that during course of investigation, no material has come against the petitioner and charge sheet has been submitted under Sections 302 and 201/34 of the Indian Penal Code. Learned counsel next submits that the petitioner has got no criminal antecedent and he is in custody since 8.11.2020. Regards being had to the submission made by the the parties and taking into consideration the materials on record, the fact that the petitioner is not the family member of the husband of the deceased, no overt act has been alleged against the petitioner and the petitioner is in custody since 8.11.2020
Patna High Court CR. MISC. No.28214 of 2021(2) dt.06-12-2021 3/3 and charge sheet has already been submitted in the matter, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Mahua P.S. Case No. 399 of 2021. It is made clear that at the time of furnishing bail bonds all the parties shall follow the guidelines regarding social distancing.
