Case No.18 of 2012 registered for the offences under Sections- 302 read with 34 of I.P.C. A.B.A. No.369 of 2012 filed for grant of anticipatory bail in the court of learned Sessions Judge was dismissed on 2.4.2012. Hence, this application for grant of anticipatory bail under Section-438 of Cr.P.C. Heard learned counsel for the petitioner and learned A.P.P. for the State.

On 27.4.2012, this Court had called for the carbon copy of the case diary which has since been received. Whatever be the merits of the matter, the application has been pending for the past three years and in case the petitioner is set at large, there is no point in arresting him. The police can certainly examine him even

Patna High Court Cr.Misc. No.17663 of 2012 (5) dt.10-03-2015 2/2 without arresting him. Hence, this application is allowed. In the event of arrest, the petitioner is directed to be released on bail upon furnishing the bail-bond of Rs.10,000/- (ten thousand) along with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in connection with Matihani P.S. Case No.18 of 2012 in G.R. No.510 of 2012, subject to the conditions laid down under Section-438(2) of Cr.P.C. However, he shall cooperate with the police in the investigation.
