The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341/323/504/34 of the Indian Penal Code and section 3(1) (x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.
It is alleged against the petitioner and his father that they abused the informant by calling caste name and the petitioner assaulted the informant with shoes. It is submitted by learned counsel for the petitioner that the informant has been set up by the persons with whom the petitioner is on litigating terms. Moreover, no injury has been caused to the informant.
Patna High Court Cr.Misc. No.26494 of 2015 (3) dt.23-07-2015 2/2 Considering the nature of accusation, it is a case for consideration of prayer for regular bail. Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Sitamarhi SC/ST P.S. Case No.12 of 2015, pending before the learned Chief Judicial Magistrate, Sitamarhi. With the above observation, this application is, accordingly, disposed off.
