JUSTICE DINESH KUMAR SINGH ORAL ORDER 30-01-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 379 of the Indian Penal Code.

The prosecution case is that on 12.9.2015 Splandor Pro motorcycle of the informant was stolen leading to registration of FIR against unknown. During investigation one Subhash Kumar Ram was arrested on whose confession the motorcycle was recovered who confessed that he purchased the motorcycle on payment of rupees ten thousand from Ramesh Mahto and the petitioner mediated the sale.

It is submitted by the learned counsel for the petitioner

Patna High Court Cr.Misc. No.4236 of 2016 (2) dt.30-01-2016 2/2 that admittedly recovery was not made from the petitioner nor Subhash Kumar claimed to have purchased it from the petitioner. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, East Champaran at Motihari in connection with Ramgarhwa P.S. Case No.104 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
