JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 09-11-2017 Heard the learned counsel for the petitioners as well as the learned A.P.P. for the state.
In this application for anticipatory bail the petitioners apprehend their arrest in connection with Atri P.S. Case No. 111 of 2016 for the offences punishable under sections 295 and 427 of the I.P.C.
Allegedly, pillar of kachcha majar of Makhdum Saheb was uprooted and when the protest was made by the informant the petitioners and others started quarreling and they were not ready to fix pillar. Information was given to the Block Officers and the Sub. Divisional Officers and the Officers came and tried to pacify the matter but the accused persons were not ready to fix pillar.
Patna High Court Cr.Misc. No.51966 of 2017 (2) dt.09-11-2017 2/2 Submission is of false implication and that after investigation the case was found false against the petitioners and accordingly final form was submitted but cognizance has been taken on 06.04.2017 under sections 295 and 427 of the I.P.C, now the case has been compromised between the parties and cordial relation has been restored between the parties and as such the petitioners deserve sympathetic consideration. The learned A.P.P. submits that in view of compromise lenient view can be taken.
In the facts and circumstances stated above, the petitioners, in case of their arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of C.J.M, Gaya in connection with the aforementioned case, subject to the condition as laid down under section 438 (2) of the Cr.P.C.
