This application has been filed for modification of the order dated 10.01.2019 passed in Cr. Misc. No. 77197 of 2018. Learned counsel for the petitioner submits that in para no. 3 of the bail application due to inadvertence wrong statement has been made that 'the petitioner has no criminal antecedent' and as a result thereof the same has also been mentioned in submission part of the order dated 10.1.2019 granting bail to the petitioner. But before release of the petitioner, he has filed this application stating that the petitioner is accused in 4 other cases also.

Considering the fact that the petitioner has made

Patna High Court CR. MISC. No.24480 of 2019(2) dt.08-05-2019 2/2 statement by filing this application that he is accused in four other cases also and rectified his mistake, the Court accept the statements made in para-3 of this application. Let the submissions part of the counsel for the petitioner in para 3 of the order dated 10.01.2019 that "petitioner has no criminal history" be treated to have been deleted. Since the petitioner has remained in jail for more than six months, the petitioner shall be released on bail in terms of the order dated 10.1.2019, subject to the condition that the bailors shall be family members of the petitioner. The aforesaid correction may be read into the order dated 10.1.2019. The order dated 10.01.2019 passed in Cr. Misc. No. 77197 of 2018 is modified to the aforesaid extent. With the aforesaid, the present application stands allowed and disposed of.
