JUSTICE AJAY KUMAR TRIPATHI ORAL JUDGMENT Date: 03-10-2016 As per Annexure- A, which is a notification dated 15.10.2012 issued by the Department of Education, Government of Bihar, a teacher in the primary school must complete four years as a graduate trained teacher before his or her turn for consideration of promotion as a Headmaster can arise.

Even according to the petitioner, she was granted benefit of graduate trained on 31.12.2012. She is obviously short of the requirement of four years and that is the only reason why her name did not figure in Annexure- 12 to the writ application, which is under

Patna High Court CWJC No.9529 of 2016 dt.03-10-2016 2/2 challenge. There is no merit in the writ application. In fact, the writ application has been moved prematurely.

Writ is dismissed.
