Petitioner seeks bail in connection with Barauni P.S. Case No. 97 of 2018 registered for the offence punishable under section 392 of the Indian Penal Code.
Learned counsel appearing for the petitioner submits that petitioner is not named in the first information report and he has been implicated in the present case on basis of the confessional statement of the co-accused in which he stated that after using the mobile in question handed over the same to the petitioner. Petitioner has not been put on TIP. Petitioner is in custody since 19.05.2018.
Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, be released on bail on furnishing bail
