The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420, 406 and 379/34 of the Indian Penal Code.
The prosecution case is that co-accused Lakshtra Biswas cut soil from 15 katha land of the District Board, Madhepura and subsequently sold it to the accused persons including the petitioner thereby caused loss of Rs.1,78,500/- to the District Board.
It is submitted by learned counsel for the petitioner that thrust of accusation is against Lakshtra Biswan and even assuming the accusation the petitioner is a bonafide
Patna High Court Cr.Misc. No.23424 of 2016 (2) dt.24-05-2016 2/2 purchaser of the soil.
A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the thrust of accusation against Lakshtra Biswan, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura in connection with Murliganj P.S. Case No. 183 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) DKS/- U T
