Petitioners apprehend arrest in a case registered for the offence punishable under Sections 188, 272, 273 of Indian Penal Code and Sections 30(a), 34, 44, 45 of Bihar Prohibition and Excise Act, 2016 As per prosecution case, 5 liters country made liquor was recovered from the house of one Chaho Urao. Later, petitioners along with 35-40 ladies attacked the Police party and obstructed them during discharge of their duties. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in

Moreover, there is general and omnibus allegation of assault against the petitioners and no specific overt act has been alleged against the petitioners. However, there was some scuffle at the place of incident but nobody sustained injury. Petitioners have got clean antecedent.

Considering the aforesaid facts and circumstances, let the above named petitioners in the event of their arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Learned Exclusive Special Judge Excise II, Araria in Bhargama P.S.
