Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are apprehending their arrest in connection with Baligaon P.S. Case No. 20 of 2015 for the offences instituted under Sections 420, 467, 468, 471 and 120(B)/34 of the IPC.

The prosecution story, in brief, is that the land belonged to R.S.P. No. 2943 under Khata No. 61 Area 9 decimal is

Patna High Court Cr.Misc. No.28040 of 2015 (3) dt.09-09-2015 2/3 Khatiyani land of the informant which has been rented in the name of Ishwar Ram, father of the informant and uncle Heman Ram. It is alleged that on 08.08.2014 the petitioners after hatching a conspiracy a sale-deed alleged to have been executed by the informant in the name of Munnar Devi. The informant got the certified copy of the aforesaid sale-deed obtained and came to know that the petitioners under conspiracy executed the sale-deed. It is alleged in the F.I.R. that the main conspirator and identifier is Manoj Kumar Singh, petitioner.

It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. It is further submitted that the matter relates to purchase of land where the title is not disputed by the informant. The matter relates to the civil in nature hence no criminal offence is made out against the petitioners. On behalf of the State it has been submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner nos. 1 and 4, namely, Munnar Devi and Santosh Ram respectively, be released on bail in the event of their arrest or surrender before the learned court below within a period of four weeks from today in connection with Baligaon P.S. Case No. 20 of 2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand)

Patna High Court Cr.Misc. No.28040 of 2015 (3) dt.09-09-2015 3/3 each with two sureties of the like amount each to the satisfaction of the learned J.M. Ist Class, Vaishali at Hajipur, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
