The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 25(1-B) a, 26, 35 of the Arms Act.

There is recovery of one country made pistol and two live cartridges from the house of the petitioner. It is submitted by learned counsel for the petitioner that petitioner has falsely been implicated in this case. The petitioner was not apprehended from the spot. Nothing has been recovered from the conscious possession of the petitioner. A statement has been made

Patna High Court CR. MISC. No.17665 of 2022(2) dt.19-09-2022 2/2 in para 3 of the petition that petitioner has no criminal antecedent.

Learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for anticipatory bail of the petitioner and submitted that petitioner is indulged in illegal activities and from his house illegal arms and ammunition have been recovered.

In the facts and circumstance of the case, this Court is not inclined to grant privilege of anticipatory bail to the petitioner.

The prayer for grant of anticipatory bail to the petitioner stands rejected.
