Learned counsel for the respondents submits that the petitioner's contention that the impugned order dated 02.04.2012 has been passed in violation of the principles of natural justice is ex facie incorrect as the impugned order itself narrates that numerous letters had been issued to the petitioner prior to passing of the order of blacklisting. Moreover, it is an admitted fact in paragraph 4 of the writ petition that the work in question was required to be started on 10.11.2009 which was to be completed on 09.11.2010 whereas the petitioner committed gross irregularities pursuant to which the petitioner has been blacklisted much later in the year 2012. It is,

Patna High Court CWJC No.7849 of 2012 dt.27-06-2016 2/2 therefore, submitted that the impugned order has been passed after affording due opportunity to the petitioner and the respondents cannot be faulted for the action taken against the petitioner on the ground of arbitrariness.
