The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 448, 323, 504, 506, 379, 307, 34 of the Indian Penal Code. Prosecution case is that while the informant was sitting at the door, the accused person came and abused. On protest being made the petitioner threw bricks, as a result of which the informant received three injuries of her head. It is further alleged that the petitioner dragged the informant out of the house by catching her hair log.

It is submitted by learned counsel for the petitioner that the injuries of the informant have been found to be simple in nature. Two lacerated injuries of marginal size have been

Patna High Court Cr.Misc. No.24064 of 2016 (2) dt.30-05-2016 2/2 found. No dragging injury has been found and even assuming the accusation, no offence under section 307 IPC is made out. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

The aforesaid facts constitute ground for consideration of prayer for regular bail.

Let the learned Court below consider the prayer for regular bail of the petitioner and dispose of the same preferably on the same day if the petitioner surrenders within a period of six weeks in connection with Barbigha P.S. Case No.95/2016, pending before the learned ACJM-II, Sheikhpura. With the above observation, this application is, accordingly, disposed off.
