JUSTICE MOHIT KUMAR SHAH ORAL ORDER 29-07-2019 The only grievance of the petitioner is regarding non-payment of leave encashment with penal interest by the Bihar State Forest Development Corporation Limited. A counter affidavit has been filed on behalf of the Bihar State Forest Development Corporation Limited wherein it has been stated that as far as the Corporation is concerned, it is liable to pay a sum of Rs. 2,88,427/- and for the said amount the State Government has been requested to make funds

In such view of the matter, the present writ petition stands disposed off with a direction to the Chief Conservator of Forest-cum-Managing Director, Bihar State Forest Development Corporation Limited to ensure payment of the admitted and calculated amount of leave encashment as aforesaid, within a period of four months from the date of receipt/production of a copy of this order.

It is needless to state that the Corporation shall forward a demand regarding the aforesaid amount to the State Government within a period of two weeks from today, if not already done and the State Government shall ensure availability of the aforesaid fund to the Corporation within a period of eight weeks thereafter whereupon the said payment would be made to the petitioner herein.

The writ petition stands disposed off on the aforesaid terms.
