JUSTICE SUDHIR SINGH ORAL ORDER 22-07-2015 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 399, 402 of the Indian Penal Code amd Section 25(1-b) a, 26/33 of Arms Act.
As per prosecution story, the main accusation against the petitioners is of making preparation for committing the dacoity along with other accused persons with fire arms after having gathered for committing the alleged offence. It has been submitted on behalf of the petitioners that no arms is said to have been recovered from the possession of the petitioners, which is evident from FIR itself. The name of the petitioners has come on the basis of confessional statement of
Patna High Court Cr.Misc. No.27175 of 2015 (2) dt.22-07-2015 2/2 co-accused.
On behalf of the State, it has been submitted that the names of the petitioners have come in the present case on the basis of confessional statement of co-accused. Considering the aforesaid facts, let the above named petitioners, in the event of their arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M.,Siwan in connection with Siwan Town P.S.case no.440/2014, subject to the conditions as laid down u/s 438(2) Cr.P.C.
