The petitioner is apprehending his arrest in connection with Bakhri P.S. Case No. 248 of 2012 for the offences instituted under Sections 304(B) and 120(B)/34 of the IPC. The accusation is of killing the daughter of the informant by accused persons after three months of the marriage for nonfulfilment of dowry demand. It has been submitted on behalf of the petitioner that the petitioner has no criminal antecedent. The petitioner is the brotherin-law of the deceased. There is no specific allegation made against him. It is further submitted that the petitioner has been implicated in the present case due to mistake of fact.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of four weeks from today in connection with Bakhri P.S. Case No. 248 of 2012 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Begusarai, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
