Petitioner seeks bail in connection with Isipur Barhat P.S. Case No. 10 of 2018 registered for the offence punishable under sections 420 and 379/34 of the Indian Penal Code.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has been falsely implicated in this case on basis of the confessional statement of the co-accused. Petitioner was not caught at the spot and nothing has been recovered from his conscious possession. At the time of occurrence, petitioner was admitted in the Referral Hospital, Pirpainty due to chest pain on 17.01.2018 and he was discharged on 18.01.2018. Petitioner has no criminal antecedent and he is in custody since 19.01.2018.

No.42756 of 2018(2) dt.19-07-2018 2/2 Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-VIII, Bhagalpur in connection with Isipur Barahat P.S. Case No. 10 of 2018.
