JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 10-06-2015 The petitioners apprehend their arrest in relation to Khagaria (Chitragupta Nagar) P.S. Case No.124 of 2015 instituted under Sections-420, 467, 468 and 471/34 of the Indian Penal Code.

The petitioner no.1 is a Revenue Clerk and wife of petitioner no.2. The first information report has been lodged by the Circle Officer, Khagaria, inter alia, alleging that the petitioners were instrumental in issuing forge certificates under Right to Public Service Act on bogus applications.

On behalf of the petitioners, it is submitted that there is long standing differences between the petitioners and the informant. The informant with a mala fide motive falsely implicated them.

No.17987 of 2015 (02) dt.10-06-2015 2/2 Having considered the matter and in the facts and circumstances of the case, in the event of arrest or surrender within four weeks from today, the petitioners above-named shall be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Khagaria (Chitragupta Nagar) P.S. Case No.124 of 2015, subject to all conditions as laid down in Section-438(2) of the Criminal Procedure Code, which shall continue up to submission of charge-sheet. If the petitioners are charge-sheeted, they would be required to surrender and pray for regular bail which should be decided on its own merits without being prejudiced by order of this Court.
