JUSTICE ARUN KUMAR ORAL ORDER 06-02-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Dhamdaha PS Case No. 28 of 2014 registered under Section 304B of the IPC. The allegation in brief is that the informant's daughter was married seven-eight years back and she was killed in connection with demand of dowry after assaulting her and informed that the daughter is seriously and when they reached there found the dead body. Learned Counsel for the petitioner submits that the marriage took place more than seven years back and there is no specific allegation of making demand of what amount or what article in dowry.
The fact remains that the daughter quarreled with the motherin-law and she took poison. The allegation is that she was assaulted but no antimortem injury was found on her body in the post mortem report in which the death has been opined to be due to poisoning. Having considered the said facts and circumstances, the petitioner, namely, Anil Thakur is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Purnea in connection with Dhamdaha PS Case No. 28 of 2014.
