The petitioner is in custody since 27.04.2018 in connection with Delha P.S. Case No. 103 of 2018 for the offence registered under Sections 454 and 380 of the Indian Penal Code. The allegation against the petitioner is that he had broken into the house of one Ram Lakhan Prasad on 20.04.2018 and escaped and thereafter, on 22.04.2018 he had again tried to break open the house of one Prem Kumar upon which the local people caught hold of the petitioner and assaulted him badly, as a result of which, he was to be referred to hospital. Learned counsel for the petitioner submits that only because there was some dispute between the Thana In-charge of

No.43862 of 2018 (2) dt.01-08-2018 2/2 the area and the present petitioner, he has been falsely implicated in the case and he was badly assaulted and has been languishing in jail. It is further submitted that no one has seen him breaking into the house of the persons as mentioned in the first information report.

Considering the aforesaid facts and circumstances of the case and that the petitioner has no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M.,- 7, Gaya in connection with Delha P.S.
