The petitioner has prayed for regular bail in a case instituted for the offence under Sections 341, 323, 504, 307/34 of the IPC and Section 27 of the Arms Act.

As per prosecution case, the loaded tractor with sand of informant was going for construction of house and the same was stopped by co-accused Shashi Kumar on road. It is further alleged that the co-accused Shashi Kumar and Satyendra Kumar fired upon the informant's chest, due to which he fell down.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case due to land dispute. He has committed no offence. There is no specific overt act against the petitioner rather general and omnibus allegation levelled against him. The specific allegation of shot fired to the informant is against co-accused Shashi Kumar and Satyendra Kumar, due to which he fell down. He further submitted that the others co-accused have already been granted bail by this Bench vide order dated 14.02.2023 passed in Cr. Misc No. 61864 of 2022 and its analogous cases. He is languishing in judicial custody since 30.08.2022. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-IV, Nawada in connection
