The petitioners seek bail in anticipation of their arrest in connection with Pakribarawan (Dhamaul) P.S. Case No. 238 of 2017 dated 24.12.2017 instituted for the offences under Sections 147, 148, 149, 341, 323, 384, 504 and 506 of the Indian Penal Code.

The petitioners are said to have assaulted the informant, demanded protection money from him for permitting him to ply his vehicle on the road in question. Learned counsel for the petitioners has submitted that they have been falsely implicated in this case and no money was paid to them by the informant. The occurrence arose because of some other dispute and

Patna High Court Cr.Misc. No.42175 of 2018(2) dt.20-07-2018 2/2 maliciously, the present case has been lodged. Learned counsel for the petitioners has also drawn the attention of the Court to the counter version of the occurrence vide Pakribarawan (Dhamaul) P.S. Case No. 237 of 2017 (Annexure - 2).

Regard being had to the nature of accusation against the petitioners, they are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt / production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Sri Kumar Avinash, Learned Judicial Magistrate, 1st Class, Nawadah in connection with Pakribarawan (Dhamaul) P.S. Case No. 238 of 2017, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
