The petitioner seeks bail in anticipation of his arrest in connection with Khodwandpur P. S. Case No. 69 of 2018 dated 19.04.2018 instituted for the offences under Sections 341, 323, 354(B), 307, 504 and 34 of the Indian Penal Code.

Though the petitioner along with his father is said

No.16465 of 2019(2) dt.15-03-2019 2/3 to have assaulted the informant of this case, but the learned counsel for the petitioner has shown from the averments made in the F.I.R. that the petitioner is the own nephew of the informant and there is a dispute in the family with respect to partition of property. The whole occurrence is stated to have taken place while an attempt was made by the informant to construct a house on the plot of land over which the petitioner and his father have also staked their claim.

Considering the aforesaid background in which the occurrence is said to have taken place; relationship between the parties; as also taking into account the delay of three days in lodging the F.I.R., the petitioner, above-named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt / production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Manjhaul, Begusarai in connection with
