====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 23-06-2023 Heard learned counsel for the petitioners and learned A.P.P. for the State.
The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 302, 341, 323, 504, 354 and 34 of the Indian Penal Code. The informant alleges that on account of dispute relating to share in the property the present occurrence is alleged to have taken place wherein it is alleged that the accused persons including the petitioners assaulted her father and mother with lathi and tried to outrage the modesty of her mother. Learned counsel for the petitioners submits that the
Patna High Court CR. MISC. No.20192 of 2023(2) dt.23-06-2023 2/2 petitioners are persons with clean antecedent and petitioner nos. 1 to 3 are women. Learned counsel next submits that petitioner nos. 1, 2 and 3 are aunt of the informant and petitioner no. 4 is cousin brother of the informant, it is next submitted that on account of dispute relating to property the alleged occurrence has taken place and the allegation of assault is also general and omnibus in nature.
Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Khagaria P.S. Case No. 1067 of 2022 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
