2. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 126(2), 115(2), 109, 351, 352, 316(2), 318(4), 3(5) of the Bharatiya Nyaya Sanhita.

As per prosecution case, this petitioner along with other two other F.I.R. named accused persons took Rs. 10 lacs, in total, from the three informants and fraudulently registered the land in their names, which in turn was found to be of the brother of this petitioner. Thereafter, upon objection, petitioner promised to register another land in their names or return Rs. 10 lacs but despite several requests, petitioner failed to do so and abused and assaulted them.

4. Learned counsel for the petitioner submits that petitioner is ready to refund Rs. 3 lacs to the informants, which was, admittedly, given to the petitioner by them. By filing supplementary affidavit, learned counsel for the petitioner admits to refund Rs. 3 lacs in two equal installments. Furthermore, learned counsel for the petitioner handed over the demand draft bearing no. 121570 issued by Canara Bank, Fatwah of Rs. 1,50,000/- to learned counsel for the informant, in the name of informant Sarita Devi (Annexure-P/1 to the supplementary affidavit) in the Court today and intends to pay the remaining amount of Rs. 1,50,000/- after eight weeks from today.
5. Learned counsel for the informant did not oppose and received the aforesaid demand draft.
6. Considering the aforesaid facts and circumstances, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali in connection with Raghopur P. S. Case No. 187 of
Patna High Court CR. MISC. No.18039 of 2026(4) dt.23-07-2026 3/3 2025, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita with direction to the petitioner that :- (i) Petitioner shall refund the remaining amount of Rs. 1,50,000/- (Rs. One Lakh Fifty Thousand) through Demand Draft to the informant within two months from the date of furnishing bail bond, failing which, the learned court below would be at liberty to cancel the bail-bond.
