JUSTICE DINESH KUMAR SINGH ORAL ORDER 01-10-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 497, 323, 324, 307, 384, 379, 504 and 506/34 of the Indian Penal Code. The prosecution case is that the accused persons including the petitioners came variously armed when petitioner no.2, Munna Kumar inflicted injury with farsa on the right hand of the informant and when the nephew and brother of the informant came to rescue, they were also assaulted when accused persons snatched gold chain from the nephew of the informant. It is submitted by learned counsel for the petitioners that there is counter version of the occurrence also and except one, the accusation is omnibus and general.

Considering the specific accusation against petitioner

Patna High Court Cr.Misc. No.36883 of 2015 (4) dt.01-10-2015 2/2 no.2 Munna Kumar, this Court is not inclined to grant him anticipatory bail.

Let the learned court below consider the prayer for regular bail of the petitioner no.2 if he surrenders within a period of six weeks.

So far as petitioner no.1 is concerned, considering the omnibus and general accusation against him and statement made in paragraph no.3 of the petition that the petitioners have no criminal antecedent, let him be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, (West) Muzaffarpur in connection with Paroo P.S. Case No. 62 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Amrendra/- U T
