Heard learned counsel appearing for the petitioners as well as learned Additional Public Prosecutor for the State through video conferencing.

Petitioners are in jail custody since 23.10.2019 in connection with Khodawandpur P.S. Case No. 219 of 2019 registered for the offences punishable under Sections 413, 414, 465 and 467/34 of the Indian Penal Code. Petitioners were caught by police officials when they were going on motorcycle and it is said that Rs.

Patna High Court CR. MISC. No.20680 of 2020(2) dt.03-09-2020 2/3 87,900/- was recovered from their possession and the motorcycle was stolen property.

Learned counsel of the petitioners submits that no such occurrence, as alleged in the written report, did ever take place and, as a matter of fact, the petitioners were caught by the police when they boarded in a bus and police asked the petitioners to hand over their money but when they refused, they were implicated by the police in this false case. Learned counsel of the petitioner, further, submits that the petitioners were remanded in two other cases, which have been disclosed at paragraph 3 of the petition after arrest in the present case and, moreover, the petitioners have already been granted privilege of bail in those cases in which petitioners were remanded after their arrest in this case.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Manjhaul, Begusarai in connection with Khodawandpur P.S. Case
