The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 409/34 of the Indian Penal Code.
In view of the order dated 27.06.2022, the District Magistrate, Gopalganj is present in the Court. Learned counsel for the State has filed the counter affidavit in the Court. Let it be kept on record. By way of counter affidavit, it has been submitted by the learned counsel for the State that the petitioner has completed the construction work of School Building in the month of January, 2020 and no due was pending against the petitioner in view of report submitted by the District Programme Officer, SSA, Gopalganj. Considering the facts and circumstances of the
Patna High Court CR. MISC. No.27549 of 2021(8) dt.28-06-2022 2/2 case, let the above named petitioner in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Kateya P.S. Case No. 169 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
The personal appearance of the District Magistrate, Gopalganj is dispensed with.
