JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-11-2017 The petitioner seeks regular bail in connection with Motihari Town P.S. Case No. 175 of 2017, registered for offences punishable under Section 401 of the Indian Penal Code. Police on patrolling found three suspicion persons, who tried to flee away but were caught and from possession of petitioner one master key was recovered.
It has been submitted on behalf of the petitioner that save and except the allegation that one master key was recovered, there is absolutely nothing against the petitioner. Further he has been in judicial custody since 21.03.2017 and though he is accused in tow more case but he has been made accused in those cases after arrest in this case.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate -1st Class, Motihari, in connection with Motihari Town P.S. Case No. 175 of 2017, subject to the following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
(ii) The petitioner shall mark his attendance in the local police station of his area in the first week of each month at least for a period of one year so that the police may watch his conduct during the aforesaid period.
(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court and on the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine reasons, the
prosecution is free to move for cancellation of his bail.
The court below before releasing the petitioner on bail shall verify his address as well as the address of bailors. Let a copy of this order be communicated to the S.P. of concerned district so as to ensure that the above direction must be complied by the petitioner.
