ANJANA MISHRA ORAL ORDER 31-08-2016 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.
The petitioners are apprehending their arrest in connection with Karakat P.S. Case No. 8 of 2016 registered for the offences punishable under Sections 147, 148, 149, 342, 323, 324, 307/34 of the Indian Penal Code.
Learned counsel for the petitioners submits that for
Patna High Court Cr.Misc. No.23619 of 2016 (3) dt.31-08-2016 2/2 the same occurrence, Karakat P.S. Case No. 7 of 2016 has already been registered by the S.I. R.N. Singh in which also some of the petitioners are apprehending their arrest. It is further submitted that the present case has been lodged by a co-villager making the same and similar allegations and from the present FIR, it is predominantly clear that the dispute was with regard to the construction of drain over the lands belonging to the petitioners where the school had been constructed.
In view of the nature of allegations made against the petitioners and that there is no specific role assigned to any of the petitioners, let the petitioners above named, in the event of their arrest or surrender before the Court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Bikramganj, Rohtas in connection with Karakat P.S. Case No. 8 of 2016 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
