The matter has been listed under the heading "For Orders" under the orders of Hon'ble the Chief Justice. Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in a case registered under Sections 8/20(b)(ii)(c)/29 of the NDPS Act.

Allegedly, 120 kg. Ganja is said to have been recovered in this case.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 02-08-2019. Charge sheet has already been submitted. The petitioner was not apprehended on the spot. The name

Patna High Court CR. MISC. No.16880 of 2020(2) dt.02-06-2020 2/2 of the petitioner was disclosed by co-accused. The other co-accused with similar allegation has been granted bail by a coordinate bench of this court (then His Lordship was) by order dated 13-12-2019 passed in Cr. Misc. No. 85135 of 2019.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances of the case and also the lockdown, the petitioner, above named, is directed to be released on bail on his personal bond to the satisfaction of learned Additional Sessions Judge-IV-cum-Special Judge, NDPS Act, Gaya in connection with NDPS Case No. 03 of 2019/53 of 2019 arising out of Amas P.S. Case No. 150 of 2019. Once the normalcy is restored, the petitioner shall furnish bail bonds of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each within a period of four weeks to the satisfaction of the court concerned in connection with the aforesaid case.
