JUSTICE DINESH KUMAR SINGH ORAL ORDER 27-07-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341,323,324,354 and 504/34 of the Indian Penal Code and sections 3(1)(v)(x)(xi) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.
It is alleged that for the protest made for ploughing of land the informant was abused by calling the caste name when the informant's sister and sister in law (bhabhi) came to rescue they were also assaulted.
It is submitted by the learned counsel for the petitioners that in the background of dispute between the parties where a
Patna High Court Cr.Misc. No.29333 of 2015 (2) dt.27-07-2015 2/2 proceeding under section 107 Cr.P.C. was initiated, the accusation has been levelled. It is further submitted that at earlier point of time petitioner no. 1 filed Complaint Case No. 307C of 2015 against the informant side.
Considering the accusation made in the background of dispute with regard to the land in question, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Araria in connection with Forbisganj (Simraha) P.S. Case No. 41 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
